1. Overview
The Family Educational Rights and Privacy Act (FERPA) is a federal law that protects the privacy of student education records. When Pocket Tutor is adopted by a school or district, we act as a "school official" with a legitimate educational interest, as defined under FERPA, and handle student data accordingly.
2. Our Commitment
When providing services to schools and districts, K12 Tutor Connect agrees to:
- Use personally identifiable information from education records only for the purposes for which the disclosure was made — to provide tutoring services
- Not re-disclose student information to third parties without proper authorization, except as required by law or as permitted under FERPA
- Maintain reasonable security measures to protect student education records
- Return or destroy student education records upon request when no longer needed for the purpose for which they were provided
3. Education Records
In the context of school and district subscriptions, the following data may constitute education records under FERPA:
- Student name and grade level
- Tutoring session transcripts and content
- Academic performance data (mastery tracking, session ratings)
- Progress reports generated for teachers and administrators
4. Parental and Eligible Student Rights
Under FERPA, parents (and eligible students aged 18+) have the right to:
- Inspect and review their child's education records maintained by the App
- Request amendment of records they believe are inaccurate
- Consent to disclosure of personally identifiable information (except in cases where FERPA authorizes disclosure without consent)
5. School and District Administrator Access
School and district administrators with valid accounts may access:
- Aggregate usage and performance data for enrolled students
- Individual student progress reports (as authorized by the school)
- Teacher assignment and activity data
Access is controlled through role-based permissions (District Admin, School Admin, Teacher) with appropriate access levels at each tier.
6. Data Processing Agreement
Schools and districts entering into a subscription agreement with K12 Tutor Connect may request a Data Processing Agreement (DPA) that outlines specific data handling obligations. Contact Schools@k12tutorconnect.com to initiate a DPA.
7. Data Security
We implement industry-standard security practices to protect student education records, including:
- Encryption of data in transit (TLS/SSL) and at rest
- Role-based access controls
- Secure authentication with hashed passwords
- Regular security assessments
- Employee training on data privacy and security
8. Breach Notification
In the event of a data breach involving student education records, K12 Tutor Connect will promptly notify affected schools and districts in accordance with applicable state and federal requirements.
